This is an anti collection method strategy that has worked very well for a number of our clients (who don’t file bankruptcy or later file bankruptcy because the strategy does not produce the relief from harassing creditor calls and collection lawsuits).
When a client, usually elderly who is on social security or SSI, with no assets (maybe only an old car), household and personal items and rents (or owns real estate with zero equity) approaches us about a bankruptcy we first look at the type of debts and source of income to determine if the qualify for this option.
If their only source of income is from social security and have no other assets we then can send out a letter to their creditors demanding that they cease all further collection activity because they are “judgment proof” and further efforts will be futile since they have no money or assets to attach. Social Security benefits are EXCLUDED from attachment by creditors. We have had great success with this strategy.
It’s simple, straightforward and cheaper than filing bankruptcy.
However, with all simple strategies there are downsides.
First, the debt still exists (it has not been discharged).
The original creditor may stop calling you, but that does not mean a collection agency who buys the debt months or years later will not attempt to collect. They are in the same position as the original creditor (you are still judgment proof) but that will not stop there attempts to collect (including harassing phone calls). If you later come into any money than that money would than be subject to attachment by your creditors.
This strategy has been very effective at stopping the phone calls and collection activity, but it does not discharge the underlying debt. Talk to us about this option.
