What is a Pre-Bankruptcy Consultation?

Wednesday, July 22nd, 2009

If you have not yet filed bankruptcy and are still in the decision making and information gathering phase or are unsure of what options may or may not be available to you it never hurts to get a second opinion or have your situation professionally analyzed.

If you’ve been research bankruptcy, looking for a bankruptcy attorney in Fresno, Madera, Merced, Los Banos, Atwater, Mariposa, Visalia or Hanford and have been reading my blog posts you are invited to call and make an appointment either in my Fresno or Merced Office.

If you are simply paralyzed and can’t or won’t make a decision or another family member is frozen or has their head buried in the sand, and they are still incurring credit card debt or thinking about raiding the 401k or retirement plans maybe now is the time to hear same plain simple advice.

Or if you have already decided to file bankruptcy, but need help or want a second opinion.

If any of these situations apply to you, call my office today to make an appointment. You will meet with me personally, not a paralegal or a secretary. I won’t have you fill out an hour long questionnaire.

A lot of “high volume” one size fits all bankruptcy attorneys will have you fill out long detailed questionnaires and than meet with a “paralegal” to discuss your case, and you only get to meet the attorney for a few minutes at the end of the consultation. I don’t take that approach.

The initial meeting is designed to answer your questions, as well as to assess your personal financial situation. Everyone’s situation is different, so I do not give initial consultations over the phone; nor do I use paralegals to conduct initial client interviews.

My main office is in Fresno and all calls, mail and appointments are scheduled through my secretary/paralegal Mandy. You can call here between 8 a.m. and 5:30 p.m. The number is (559) 228-1500. She is usually the first one in the office, so it’s very easy to reach her right at 8:00 a.m. We are conveniently located on Shaw between West and Marks Avenue. Our address is 2440 West Shaw Avenue, Suite 114.

We also maintain an office in Merced at 720 West 19th Street. The phone number is (2099) 722-3900. Although this is a Merced number, the phone rings in Fresno, so go ahead and ask for Mandy. All appointments are made through the Fresno Office. I maintain office hours each Wednesday. If you are coming from Mariposa, Los Banos, Atwater, Oakhurst or Chowchilla and you want to meet in the Merced office make sure you tell Mandy which office you want to schedule your appointment.

IMPORTANT: Although the initial interviews are “no cost” – they are not free.

If you decide to hire me as your lawyer the initial consultation is part of the fee that you will pay. I do not have a set fee schedule as each case is different. We will discuss fees at the time of the consultation.

If you decide not to hire me you do not pay any money. BUT keep in mind that this is a consultation to review your financial situation and determine a course of action. My job (whether I receive any money is to help you – be that advice or legal services), so there is an investment in time and energy for each of us. So, what’s in it for me if you don’t hire me?

Well if I can help you. I will be the first to admit it. Bankruptcy is not always the best or only course of action. Sometimes because of the law and factors beyond our control you may not qualify for bankruptcy or it may be a decision you do not want to make at this time (or ever).

I will promise you one thing, after our consultation you will have gotten my “best” – whatever that is: advice, a plan of action, a recommendation. You are the one that makes the decision. That’s all that I can promise.

In return, I require only two things: (1) You show up at the scheduled time (we ask for telephone number specifically to confirm appointments); (2) You bring the documents and information requested at the time you schedule the appointment.

We must be able to confirm appointments otherwise we will assume that you are not serious. Since we are offer a valuable consultation this is a minimal requirement on your part.

If necessary, we can usually get you in on an appointment within a day or two. However, when you call to talk with Mandy mention your special circumstances and your need for an immediate appointment. Please be aware though you may have to travel to Fresno or meet early a.m. or after 5:00 p.m. We do make Saturday appointments when are schedule is booked, but currently they are only set in the Fresno office.
